Membership Terms

SiamSportsPro Tennis Academy Phuket does not hereby grant the Member the exclusive, transferable right to use the facilities. The member may be subject to any additional changes, located within SiamSportsPro Tennis Academy Phuket such at times and is subject to the rules and regulations as may be determined by SiamSportsPro Tennis Academy Phuket from time to time at its discretion.

  1. Membership is exclusive only to the member and is non assignable, non-transferable and non-refundable. A member may not loan his/her membership card to be used by a third party. SiamSportsPro Tennis Academy Phuket may assign the benefit of these agreements to any person, firm or company at any time without notice to the member.
  2. SiamSportsPro Tennis Academy Phuket may terminate the Members’ membership without refund for any breach or failure to comply with the terms and conditions, rules or by-laws of SiamSportsPro Tennis Academy Phuket and seek further compensation for all loss and damage, including but not limited to legal costs suffered as a result of such failure or breach by a member.
  3. SiamSportsPro Tennis Academy Phuket reserves the right to adjust both the membership fee and benefits at any time and without notice. Any increase in the membership fee will not affect existing members; however, any existing member coming up for renewal will be subject to the price change.
  4. No refund shall be given for any period for the membership when not in used.
  5. All new memberships and membership transfers are subject to the approval of the Management. The Management reserves the right to reject any application for membership to SiamSportsPro Tennis Academy Phuket for any reason whatsoever.
  6. Upon acceptance, the member will be issued with a membership card (which shall remain the property of SiamSportsPro Tennis Academy Phuket and the member shall be entitled to all the rights and privileges under the type of membership. If a membership card is lost or misplaced, the Management will issue a replacement card at a nominal fee.
  7. Any member wishing to enter SiamSportsPro Tennis Academy Phuket without a valid membership card/ID will only be admitted at the discretion of the Management.

Physical Condition of Member or Guest

  1. The Member warrants and represents that he or she is in good physical condition and able to use the equipment provided and to participate in the exercise and tennis programs made available by SiamSportsPro Tennis Academy Phuket.
  2. SiamSportsPro Tennis Academy Phuket represents that its sports personnel have no expertise in diagnosing, examining or treating medical conditions of any kind or condition. The member fully understands and agrees that in participating in one or more of the programs or using the facilities in SiamSportsPro Tennis Academy Phuket, there is a possibility of accidental or other physical injuries.
  3. The member agrees to assume the risk of such injury and further agrees to release, indemnify and defend SiamSportsPro Tennis Academy Phuket, subsidiaries, affiliates, shareholders, and employees from any and all liability whatsoever as a result of use by the Member or his/her permitted guests of the facilities and instructions offered by SiamSportsPro Tennis Academy Phuket.
  4. If the Member has a history of heart disease or other serious medical conditions, the Member should consult a physician before executing this agreement.
  5. The member shall not use any academy facilities whilst suffering from any infections or contagious illness, disease, or other ailments such as open cuts, abrasions, open sores, or minor infection, where there is a risk that such use may be detrimental to the health, safety, comfort or physical condition of other members.
  6. For safety reasons, you are responsible for correctly using all academy facilities and equipment. If you are not sure how to use any equipment, always ask a member of our coaching team.
  7. The Member shall use the facilities and equipment in SiamSportsPro Tennis Academy Phuket at his/her own discretion and SiamSportsPro Tennis Academy Phuket shall not be liable for any risks that arise.

Membership Vouchers

  1. Members may deallocate one or more of their pre-allocated membership vouchers without charge at any time prior to the start date of said voucher. Used Membership Vouchers cannot be deallocated or suspended once used.
  2. A member must give advance notice to deallocate a Membership Voucher in writing before it has been used.
  3. A written confirmation shall be issued by SiamSportsPro Tennis Academy Phuket to confirm that the Membership Voucher/s has been unallocated.
  4. Membership Vouchers must be used before the expiry date of the voucher. Any Membership Voucher/s that are not used before the expiry are lost.
  5. Inactive Members may still use SiamSportsPro Tennis Academy Phuket facilities whilst inactive as a guest but would not be entitled to any Member benefits during this period.

Expulsion of Members and Guests

In the following circumstances management may terminate the membership of any member and the termination shall take immediate effect without the need to notify the member in advance:

  1. Without notice and with immediate effect if a member’s conduct, whether or not such conduct is the subject of a complaint by another member or members, is such that in the reasonable opinion of the Management, it is harmful to the character and/or interests of SiamSportsPro Tennis Academy Phuket.
  2. Without notice and with immediate effect if the member has committed any breach of these rules or of the Rules & Regulations of SiamSportsPro Tennis Academy Phuket as are from time to time in force.
  3. If any monthly membership fees or locker fees remain unpaid after the due date for payment.
  4. Upon notice in writing, if SiamSportsPro Tennis Academy Phuket is of the opinion that the member is not a suitable individual for continued membership of SiamSportsPro Tennis Academy Phuket.
  5. Without notice and with immediate effect if a member is found to have violated the privacy of any other member within the shower and the changing rooms or are caught in lewd or compromising actions.
  6. A member whose membership is terminated by the Management shall forfeit all the privileges of membership with immediate effect without claim of any refund of his/her initial Start-up Fee or Monthly Membership dues, other than any monthly membership dues paid in advance. Upon termination of his/her membership the member shall return forthwith his/her membership card and any other evidence or property of membership provided to that member by SiamSportsPro Tennis Academy Phuket and shall settle any outstanding debts.

Termination of Membership

In the following circumstances, SiamSportsPro Tennis Academy Phuket has the right to terminate any membership without notice period.

  1. Act deliberately or with gross negligence, causing damage to the academy exercise tools or equipment or preventing them from normal use.
  2. Undertake any act in a manner that constitutes a trade or provision of services inside SiamSportsPro Tennis Academy Phuket, for instance, teaching exercise/technique methods to other persons on the facilities, selling food, beverages, vitamins, drugs, food supplements, or any other acts suggestive to seek benefits the reform, etc.
  3. Puts the member or other persons at risk when using the facilities’ services or abuse or misuse of physical enhancement drugs, including but not limited to illegal use of drugs or drug overdose or intake of food and drug administration unapproved drugs.
  4. The member conducts any actions that jeopardize SiamSportsPro Tennis Academy Phuket’s reputation, prestige, property, or commercial interest. The membership expiration date shall be the last day of the month based on the calculation method.
  5. The member deliberately commits a crime.
  6. The member behaves in a manner that disturbs the use of the services at academy by other members.
  7. The member is infected with severe contagious diseases.
  8. Selling personal training between members using SiamSportsPro Tennis Academy Phuket facilities in teaching is forbidden.
  9. Soliciting and selling private personal training sessions or merchandises to any member are prohibited.
  10. The Management reserves the right to use any individual or group photographs of members and/or guests for press or promotional purposes.
  11. All members must abide by the rules of SiamSportsPro Tennis Academy Phuket which may be amended, varied, deleted, and added from time to time at Management’s discretion.
  12. Failure by the Management to enforce any of their respective rights at any time for any period shall not be construed as a waiver of such rights.
  13. These Rules shall be governed and construed in accordance with the laws of Thailand and subject to the jurisdiction of Thailand.

Limitations of Liability

In consideration for the Management accepting his/her application for membership of SiamSportsPro Tennis Academy Phuket and for him/her becoming and remaining a member or guest of SiamSportsPro Tennis Academy Phuket, the member or guest agrees that:

  1. SiamSportsPro Tennis Academy Phuket accepts no responsibility for loss, stolen passes or damage to members’ or their guests’ properties or for death or injuries sustained while on the premises. Members and their guests agree that no claims will be made against SiamSportsPro Tennis Academy Phuket, SiamSportsPro Tennis Academy Phuket, the Management or staff for any reason whatsoever.
  2. SiamSportsPro Tennis Academy Phuket, its associated companies, employees or agents shall not be held responsible for any claims, demands, injuries, damages or actions for negligence arising on account of death or due to injury, loss, damage or theft to a member’s person or property arising out of or in connection with the use by a member of any of the services, facilities on the premises of SiamSportsPro Tennis Academy Phuket. The member hereby holds SiamSportsPro Tennis Academy Phuket, SiamSportsPro Tennis Academy Phuket, its associated companies, employees and agents harmless from all claims which may be brought against them by or on a member’s behalf for any such injuries or claims aforesaid.
  3. Any guest of a member or a temporary visitor to SiamSportsPro Tennis Academy Phuket shall agree to abide with SiamSportsPro Tennis Academy Phuket rules and the same limitation of liabilities for a member shall apply.
  4. Facilities may change operating hours; close due to refurbishing, capacity, weather or for special events; and may otherwise change or be discontinued without notice and without liability.

Photo Release

By enrolling your child/children in SiamSportsPro Tennis Academy Phuket classes/products, the parents understand that when participating in training, events, or other social events, the registered child may be photographed for print, video or electronic imaging for the purpose of promotional materials, publication, SiamSportsPro Tennis Academy Phuket’s website, and other published formats. Under no circumstances will SiamSportsPro Tennis Academy Phuket use or distribute such pictures for sales or profit purpose other than these specific purposes.

As part of the registration process, therefore, all parents and legal guardians must sign this Photo Release Form to complete the registration.

I (Parent / Guardian) hereby give “SiamSportsPro Tennis Academy Phuket” the right and permission to publish my child’s photographic image for the specific purpose of publication to their website (https://siamsports.pro), and other promotional materials. In giving my consent, I hereby release and hold harmless SiamSportsPro Tennis Academy Phuket, their employees, agents, and designers, from any and all responsibility and liability. I understand that I will receive no compensation, should any photographs of my child be used.

SiamSportsPro Tennis Academy Phuket will not tag or identify any child in any photography in print or online at any time
